Dublin procedure: which country is responsible?
Your fingerprints were found in another EU country, or you entered with a visa issued by another country? Then Austria first checks whether it is responsible for your case at all.
In short
- In the EU, only one country decides on an application for asylum.
- Since 12 June 2026 this is governed by the Asylum and Migration Management Regulation, still commonly called Dublin.
- Against the transfer decision: an appeal (Beschwerde) within two weeks.
- If the transfer deadline expires, Austria usually becomes responsible.
Responsibility
What it is about
In the EU, only one country is supposed to decide on an application for asylum. If, before entering Austria, you already applied for asylum in another member state, gave your fingerprints there or received a visa from there, the Federal Office for Immigration and Asylum (BFA) first checks which country is responsible. Since 12 June 2026 this is governed by the new EU Asylum and Migration Management RegulationAMMRRegulation (EU) 2024/1351. Since 12 June 2026 it determines which member state is responsible for an application for asylum. It replaced the Dublin III Regulation., which replaced the Dublin III Regulation. People still commonly speak of the Dublin procedure.
Procedure
How the procedure works
- A match in the EURODACEURODACEU database with fingerprints and facial images of asylum seekers and of people who entered irregularly. A match shows in which country you have already been registered. database, or a visa issued by another country
- The BFA sends a request to the other member state (consultation procedureConsultation procedure (Konsultationsverfahren)The BFA asks the other member state to take you in or take you back. If it agrees or does not reply in time, a transfer can be ordered.)
- InterviewInterview (Einvernahme)Questioning at the BFA in which you describe your reasons for fleeing. What you say here is the most important basis for the decision. Contradictions will later be used against you.: you can state your position on this. Family in Austria, illness or particular vulnerability must be taken into account.
- Decision: either your procedure is admitted in Austria, or the BFA orders your transfer to the other country.
Negative decision
What you can do
You can lodge an appeal (Beschwerde) against the transfer order with the Federal Administrative Court (BVwG). At two weeksDeadline: two weeksDeadline for an appeal against a transfer decision under the Asylum and Migration Management Regulation (§ 16 Abs 2 Z 3 BFA-VG), counted from service of the decision. the deadline is very short, and the appeal does not automatically protect you from the transfer. Please contact us immediately after the decision has been served on you.
Deadlines
If the transfer does not take place
The responsible country must take you over within certain deadlines. If the deadline expires without you having been transferred, Austria usually becomes responsible and decides on the merits of your application. Whether a deadline has really expired is something we clarify with the BFA before you take any step.
Family
My spouse has received protection in another EU country
If another member state has already granted asylum or subsidiary protection, Austria cannot grant it again. The route is then usually family reunification. If the application in the other country has not yet been decided, an application in Austria may be possible.
Questions we get asked
Dublin procedure: short answers
How long do I have to appeal against the transfer?
Two weeks from service of the transfer decision (§ 16 Abs 2 Z 3 BFA-VG). The appeal does not automatically protect you from the transfer. Please contact us immediately.
What happens if I am not transferred in time?
The responsible country must take you over within certain deadlines. If the deadline expires, Austria usually becomes responsible and decides on the merits. Whether the deadline has really expired is something we clarify with the BFA beforehand.
Does the Dublin III Regulation still apply?
Not for new procedures. Since 12 June 2026 the Asylum and Migration Management Regulation applies. Transitional provisions may apply to older procedures.
The Federal Administrative Court has dismissed my appeal. What now?
Within six weeks you can file a revision (Revision) with the Supreme Administrative Court (VwGH) or a complaint (Beschwerde) with the Constitutional Court (VfGH). Neither stops the transfer by itself: suspensive effect (aufschiebende Wirkung) must be applied for separately. Please contact us immediately once a transfer date has been set.
