Adoption rights
in Austria

In order to adopt a child in Austria, an adoption contract must be drawn up. The previous and future parents must be listed in this contract and they must agree to the adoption in writing and it has to be notarised. In addition, the upkeep and inheritance of the child must be recorded. The legal consequences of an adoption are also written down here. Furthermore, various documents are required for submission. Of course, it should also be noted here that no adoption is the same, which is why it is always important to have a lawyer who is at your side with all questions.

What if the previous parents live abroad?

That is also no problem. A solution can be found, for example, via the embassy of the respective country. However, every case is different and that is why a lawyer is particularly necessary for this in order to offer a tailor-made solution. In any case, the previous parents must agree in writing.

What if the biological father cannot be found?

Basically, an adoption needs the consent of both parents for the adoption to be final. However, if one of the two parents cannot be found, there is the possibility that the court will substitute this part. Especially in such cases it is important to have a lawyer to avoid unnecessary delays.

What about the right of residence of the adopted child's family?

In principle, the family of the adopted minor has the right to family reunification as long as the adoptive parents have Austrian or another European citizenship or have a right of residence here. However, there are certain conditions that do not apply in every case. That is why it is very important to have a lawyer here who can give you expert advice.
Because if an adoption is only carried out for residence purposes, there may be an offense that is punishable.
