In short

  • In Austria, only a civil marriage counts.
  • Documents usually need a certification or an apostille and a certified translation.
  • For family reunification, both of you must be at least 21 when the application is filed.
  • Marriage alone does not give you a residence permit.

Civil registry office

Well prepared for your appointment

Many couples have the same experience: every civil registry office (Standesamt) asks for something different, a certification has expired, and the next appointment is months away. If you prepare your documents correctly from the start, you save weeks.

Checklist

What the civil registry office requires from both of you

  • Photo ID (passport, identity card or asylum card)
  • Birth certificate, certified by the foreign ministry of the issuing country and super-certified (Überbeglaubigung) by the Austrian embassy (or )
  • , also certified; for non-Europeans no more than six months old
  • if you are divorced: your previous marriage certificate and the divorce judgment
  • depending on your nationality, further documents, such as a

Documents in a foreign language must be translated by a court-sworn interpreter. Asylum seekers whose proceedings are still pending benefit from simplified rules for the super-certification.

Traditional marriage

Does it count in Austria?

No. In Austria, only a civil marriage is recognised. A purely traditional or religious marriage is treated as cohabitation and is not enough for family reunification.

Residence

What the marriage means for the visa

Marriage is a requirement for family reunification, but on its own it does not give you a permit. Under the Settlement and Residence Act (NAG), both spouses must, as a rule, be old when the application is filed.

Income, accommodation, insurance and German language skills must also be in order, and the marriage must be genuinely lived: suspicion of a marriage of convenience.
