Contacting us

When you write to us or call us

When you fill in the form for the initial consultation, send us an email or WhatsApp message, or call us, we process the information you give us: your name, contact details, your request and, where applicable, any documents you send along.

We use this data to answer your request and to arrange an appointment. The legal basis is Art. 6(1)(b) of the General Data Protection Regulation (GDPR, DSGVO) (steps taken before entering into a contract). If you send us information about your health, religion or ethnic origin, for example in connection with asylum proceedings, we process it on the basis of Art. 9(2)(f) GDPR, because it is necessary to assert your rights.

If you do not engage us, we delete your request as soon as we no longer need it, unless we are required by law to keep it.

Engagement

When you engage us

To represent you, we process the data needed for your proceedings, including data about other parties involved. The legal bases are Art. 6(1)(b) GDPR (contract), point (c) (legal obligations, such as record keeping and the prevention of money laundering) and point (f) (enforcement of claims).

As attorneys, we are bound by professional confidentiality (§ 9 of the Lawyers' Act, Rechtsanwaltsordnung). We only pass on data where this is necessary for your case, for example to authorities, courts, opposing parties, interpreters or experts, or where we are required to do so by law.

After the engagement ends, we keep files for as long as the statutory retention periods require, in particular under the Lawyers' Act and the Federal Fiscal Code (Bundesabgabenordnung), and beyond that for as long as claims arising from the engagement can be asserted.

Website and forms

HubSpot

This website and the contact form run on the HubSpot platform. The provider is HubSpot Ireland Limited, One Sir John Rogerson’s Quay, Dublin 2, Ireland, acting as our processor. Form entries are stored in our HubSpot account so that we can handle your request. The data is stored in data centres in the EU.

When you open the pages, technically necessary data is processed, such as your IP address, browser, time of access and the page visited, in order to deliver and secure the website (Art. 6(1)(f) GDPR).

Data may be transferred to HubSpot, Inc. in the USA. The company is certified under the EU-US Data Privacy Framework. More at legal.hubspot.com/privacy-policy.

Cookies

Cookies and consent

We set technically necessary cookies without consent, because the website would not work otherwise (§ 165(3) of the Telecommunications Act 2021, Telekommunikationsgesetz 2021). This includes storing your cookie choice.

We only set cookies for statistics and advertising if you agree in the cookie banner (Art. 6(1)(a) GDPR). You can withdraw your consent at any time in the cookie settings. This does not affect the lawfulness of processing carried out before the withdrawal.

Statistics and advertising

Google Analytics and Google Ads

With your consent, we use Google Analytics to understand how the website is used, and Google Ads conversion tracking to see whether an ad led to a request. With your consent, HubSpot also measures which pages are visited.

The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Data may be transferred to Google LLC in the USA. Google is certified under the EU-US Data Privacy Framework. The legal basis is your consent (Art. 6(1)(a) GDPR).

Channels

WhatsApp and social networks

If you write to us via WhatsApp, the provider WhatsApp Ireland Limited also processes your data under its own terms. If you do not want this, you can reach us by phone or email.

We refer to Facebook and Instagram with simple links only. Data is only transferred when you click a link.

Your rights

What you can request

  • Access to the data we process about you (Art. 15 GDPR)
  • Rectification of inaccurate data (Art. 16)
  • Erasure (Art. 17) and restriction of processing (Art. 18)
  • Data portability (Art. 20)
  • Objection to processing based on legitimate interests (Art. 21)
  • Withdrawal of consent you have given (Art. 7(3))

To do so, write to office@anwaltklammer.com. Attorney confidentiality may limit access and erasure where third-party data or ongoing proceedings are concerned.

You can also lodge a complaint with the Austrian Data Protection Authority (Datenschutzbehörde): Barichgasse 40–42, 1030 Vienna, www.dsb.gv.at.
